Shale fee up for debate in House
It's going to be a busy afternoon in the state House, as Democrats finally get the vote they were looking for - on a shale drilling fee.
Well, sort of, anyway.
The House Republican leaders have confirmed that they'll be debating a drilling fee this afternoon, and offering their own fee proposal as an amendment.
But Democrats quickly blasted that fee, saying it was too little revenue and didn't do enough for environmental programs.
Unlike other proposals, this would use the state's Oil and Gas Lease Fund (which brings in money from gas leases on state-owned land and royalties on the gas produced by those wells) to give money to the environmental programs. The fee itself would go to counties and municipalities with active drilling, as well as conservation districts.
It should be a lengthy debate this afternoon, and even if the measure squeaks through the House, it's fate in the Senate is unclear. Senate President Pro Tem Joe Scarnati wants a drilling fee, but has been frustrated by the governor and House Republicans refusing to discuss what proposals they would consider supporting.

EPA Proposal Would Allow Energy Companies to Use Alternative ...
WASHINGTON, D.C.—The Environmental Protection Agency is proposing to allow oil and natural gas operations to use alternative emissions calculations through 2011 without obtaining prior approval from the agency under a greenhouse gas reporting rule, according to a proposed rule to be published in the Federal Register June 27.
This would be the second time EPA extended the period during which owners and operators of oil pipelines and wells can use alternative emissions calculations methods, known as best available monitoring methods, to report their greenhouse gas emissions without having to submit an application. EPA said this second extension would allow it time to address several petitions to reconsider the reporting rule from energy companies and industry trade groups.
That additional time would “provide sufficient time for companies to collect, prepare, and submit data to EPA during the initial year of reporting,” EPA said.
Proposal Would Modify Reporting RuleThe proposed rule would modify portions of a November 2010 rule at 40 C.F.R. Part 98, Subpart W, that requires oil and natural gas companies to report greenhouse gas emissions from their wells, pipelines, and other operations (75 Fed. Reg. 74,458). The proposed rule would allow oil and gas companies to use best available monitoring methods, which could include supplier data, engineering calculations, or other company records, for well-related emissions, leak detection, and measurement, and for other unforeseen circumstances until Dec. 31 without having to obtain prior approval from EPA.
The companies would be required to a submit a notice of intent to EPA by Dec. 31 if they plan to use those alternative calculations to report their greenhouse gas emissions beyond 2011. Facilities that submit that notice and file a best available monitoring methods request with EPA by March 30, 2012, will automatically be granted permission to use those alternative methods through June 20, 2012, EPA said.
